Dolphin Card Terms and Conditions

Our Partner Service Providers require that we communicate certain critical terms and conditions of their service to You, the end-customer, as part of our Terms. These Standard Terms and Conditions ("Terms", "Agreement") govern your use (as a "User") of the services, including websites, cards, extensions, and applications ("Services") managed by our Partner Service Providers (hereinafter "Partner Provider"). By using these Services, you agree to be bound by the following terms and conditions as set forth by the Partner Provider.

1. INTRODUCTION

These Terms apply to your use of the Services provided by the Partner Provider, including any additional products, goods, cards, or services accessed through our platform or third parties in a co-branded or white-label context. You may also be subject to additional agreements with the Partner Provider. Use of the Services is limited to individuals legally able to enter into contracts under applicable law (e.g., minors under 18 are not authorized). By using the Services, you represent that you are of legal age, maintain a single account, and meet all eligibility requirements. If you do not agree with these Terms, you must not use the Services, and your sole remedy is to stop using them and cancel your account with the Partner Provider. The Partner Provider reserves the right to deny access or cancel your account at any time for any reason.

2. CHANGES TO TERMS

The Partner Provider may revise these Terms at their sole discretion. Changes are effective immediately upon posting and apply to all subsequent use of the Services. Your continued use constitutes acceptance of the revised Terms. You are expected to review these Terms periodically.

3. PARTNER PROVIDER RIGHTS

The Partner Provider may deny access, terminate Services, or close accounts at their discretion without notice. If you provide false or incomplete information, violate these Terms, or engage in inappropriate conduct, the Partner Provider may terminate your access, review, delay, or cancel fund disbursements.

4. INTERACTING WITH THE PARTNER PROVIDER

Your use of the Services includes entering agreements and conducting transactions electronically. You acknowledge that electronic submissions constitute your agreement to be bound by and pay for such transactions. You are responsible for maintaining the hardware and software required to access and retain electronic records.

5. ACCESS TO SERVICES AND ACCOUNT SECURITY

The Partner Provider may withdraw or amend Services without notice and is not liable for any unavailability. You are responsible for safeguarding your account credentials and notifying the Partner Provider of any unauthorized use. The Partner Provider is the sole arbiter of account ownership disputes, and their decisions are final. You must ensure all persons accessing the Services through your account comply with these Terms and maintain access to the registered email address.

6. INTELLECTUAL PROPERTY RIGHTS

The Partner Provider and its licensors own all intellectual property in the Services. You are granted a limited license to view the material for personal use only.

7. RESTRICTIONS AND PROHIBITED USES

The Partner Provider may restrict access to certain areas of the Services. You may not share, sell, or resell account credentials. Prohibited uses include, but are not limited to:

  • Violating these Terms or applicable laws.
  • Engaging in fraud, data mining, or harmful conduct.
  • Using the Services for unauthorized commercial purposes, self-dealing, or circumvention of regulations.
  • Impersonating others or transmitting unsolicited communications.
  • Introducing malicious software or attempting unauthorized access.
  • Using the Services to exploit promotions, defraud merchants, or misrepresent transaction details.

Prohibited purchases include bank transfers, gambling, certain direct marketing services, and transactions with merchants in specified countries (e.g., Afghanistan, Cuba, Iran, North Korea, Russia). The Partner Provider may update these restrictions at their discretion.

8. SOURCE OF FUNDS

Funds from sanctioned entities, jurisdictions, or illicit activities may be restricted or reviewed at the Partner Provider’s discretion. You affirm that your funds comply with applicable laws, and no refunds or credits will be provided for unacceptable funds.

9. ELIGIBILITY FOR SERVICES

The Partner Provider may suspend or deny access if they believe you are ineligible or violate laws or policies. Restrictions may remain until eligibility is verified, and funds may be permanently restricted if eligibility cannot be confirmed.

10. NO THIRD-PARTY BENEFICIARY

These Terms are solely for the benefit of you and the Partner Provider, with no third-party beneficiary rights conferred.

11. CARD TERMS

Using any card marketed by the Partner Provider constitutes acceptance of their terms, which may include expiration or termination fees equal to the remaining balance.

12. FEES

The Partner Provider may charge processing, purchase management, or refund fees. Additional fees may apply to mitigate abusive behavior or comply with local tax regulations. Fees are non-refundable. As of the publication of these Terms, the specific fees for the Partner Provider’s cards include:

  • $4.99 per additional Non-Reloadable Dolphin Card (first card free for a limited time)
  • $4.99 per additional Reloadable Dolphin Card (first card free for a limited time)
  • 1% on all transactions, with a minimum fee of $1.00 per transaction

13. RETURNS AND REFUNDS

Not all products or services are refundable, and you must confirm specific terms with the issuer. Purchases from restricted countries or through circumvention of geo-blocking violate these Terms and may result in account suspension. Card value is not redeemable for cash, and fiat currency purchases are final. Refunds, if approved, are typically credited in Partner Provider credit, net of fees, or to the original payment method within 30 days, subject to verification.

14. ACCOUNT SUSPENSION OR TERMINATION

You may request account closure by contacting the Partner Provider. They may close accounts or deny access for any reason, review or delay fund disbursements, or take other actions if you violate these Terms or engage in fraudulent or harmful conduct.

15. YOUR CONTENT

By displaying content, you grant the Partner Provider a worldwide, irrevocable license to use, reproduce, and distribute it. Your content must be original and not infringe third-party rights. The Partner Provider may remove your content without notice.

16. COMMUNICATIONS

You agree to receive electronic communications (e.g., email, text, calls) from the Partner Provider, which may include automated messages. Opting out may impact your use of the Services.

17. RELIANCE ON PUBLISHED INFORMATION

Information on the Services is for general purposes only, and the Partner Provider does not guarantee its accuracy or completeness. Reliance is at your own risk.

18. CHANGES TO SERVICES

The Partner Provider may update content periodically, but it may not be complete or up-to-date, and they are not obligated to update it.

19. INFORMATION ABOUT YOU

All collected information is subject to the Partner Provider’s Privacy Policy. Suspicious transactions may be reported, and you may be required to complete a customer identification program.

Third-party links are provided for convenience, and the Partner Provider is not responsible for their content or any resulting loss or damage.

21. NO WARRANTIES

Services are provided "as is" with no warranties or representations.

22. LIMITATION OF LIABILITY

The Partner Provider and its affiliates are not liable for any damages arising from your use of the Services, including indirect or consequential damages.

23. INDEMNIFICATION

You agree to indemnify the Partner Provider and its affiliates against claims arising from your violation of these Terms or unauthorized use of the Services.

24. WAIVER AND SEVERABILITY

No waiver by the Partner Provider constitutes a continuing waiver. Invalid provisions will be limited or eliminated, with remaining provisions remaining in effect.

25. VARIATION OF TERMS

The Partner Provider may revise these Terms at any time, and you are expected to review them regularly.

26. VIOLATIONS OF TERMS

The Partner Provider may pursue legal and equitable remedies for violations, including blocking access or delaying fund disbursements.

27. DEFAULT

The Partner Provider may take measures (e.g., requiring justification, freezing accounts, retaining funds) to protect against suspicious or illegal actions, as determined at their discretion.

28. ASSIGNMENT

The Partner Provider may assign or transfer their rights under these Terms without notice. You may not assign or transfer your rights.

29. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and the Partner Provider regarding the Services, superseding prior agreements.

30. FEEDBACK AND CONCERNS
